International Judicial Cooperation and Protection of Public Order

Abstract

The paper presents the comprehensive study of some international aspects of the interaction between the judicial authorities of states as a multilevel legal institution ensuring public order. Building on the analysis of existing academic approaches to international judicial cooperation, an authorial definition is suggested, encompassing the diversity of forms and perspectives of such interaction to ensure public legal order at the regional level of state integration associations. The legal foundations of international judicial cooperation are examined, including key international treaties and national legislation. Special attention is given to the forms and mechanisms of the interaction among judicial authorities: bilateral cooperation, multilateral engagement within international organizations, as well as some regional aspects. The major trends of international cooperation among judicial authorities are identified and analyzed, i.e., mutual legal assistance, extradition and transfer of convicted persons, recognition and enforcement of foreign judicial decisions, and the exchange of experience between judicial systems. Current issues and prospects for the development of international judicial cooperation in modern geopolitical conditions are substantiated, including those of the digitalization of justice, and the formation of new international judicial institutions.
